DATED : DECEMBER 12, 2019 Mr. Mahajan, learned counsel for applicant, submits that this is the second application for bail however he submits that after the bail application was withdrawn by him on 09.10.2019, father of the applicant has given a document which shows that applicant is a juvenile in conflict with law.

In view of the aforesaid, it will be appropriate on the part of the applicant to file an application before the learned Judge of Court below by placing the said document on record so as to enable the learned Judge to take appropriate steps for inquiry in respect of determination of age of the applicant as contemplated under the Juvenile Justice (Care and Protection of Children) Act, 2015. On this, learned counsel for applicant, in order to avail the said opportunity, submits that he wishes to withdraw the present application with liberty to file an application before the Court below.

ba1104.19.odt The application is disposed of as withdrawn with liberty to file fresh application before the Court below along with the documents as stated above to show that the applicant is a juvenile in conflict with law. If such a document is filed in the application for bail before the Court below, it is expected from the learned Judge of the Court below to take all necessary steps, in accordance with law and pass suitable orders.
