Heard the learned counsel for the petitioners. 2.

The petitioners have approached this Court primarily seeking the relief under prayer clause (i), which is as below: "i.

issue an appropriate writ, order, or direction to expedite the Special Civil Suit no. 200752/2010 (Kunal R. Ladikar and 3 v/s Rajnish Khanorkar and Others) (Annexure - A) pending before the learned Joint Civil Judge Civil Senior Division, Nagpur in the time bound manner or direct day-to-day hearing, if necessary, as deemed fit by this Hon'ble Court;"

Considering the prayer clause (i), this Court on 16.10.2025 passed the following order:

" Heard.

During the course of hearing, our attention was drawn to order dated 19.6.2023, passed in Writ Petition No. 3611/2023, by which the suit in question was directed to be decided expeditiously. According to learned counsel for petitioner, the suit is still pending.

In that view of the matter, Principal District Judge, Nagpur is called upon to submit report in writing as to nd.thawre

2/2 pendency of the suit.

4. The Registrar (J) is directed to communicate this order to the learned Principal District Judge, Nagpur." 4.

In compliance of the order dated 16.10.2025 passed by this Court, the learned Principal District and Sessions Judge, Nagpur had filed a report on record on 11.12.2025. 5.

The aforesaid report reveals the reasons as to why the aforesaid suit could not be decided within a stipulated period as directed by this Court. However, in the last para of the aforesaid report, the Principal District and Sessions Judge, Nagpur has made a statement that he has issued directions to the concerned learned Judge to take up the matter on day to day basis to dispose of the same as early as possible.

In view of the aforesaid statement made in the report dated 11.12.2025 and the undertaking given by the parties to the aforesaid suit before this Court that they will cooperate the learned trial Court in expeditiously disposal of the suit, the grievance of the petitioner in terms of prayer clause (i) stands redressed.

In view of the above, the present writ petition is disposed of in the above terms.
