DATED : DECEMBER 11, 2019 The question of refund of the amount of Rs.89,59,232/- on account of petitioner not getting available access to the sand ghat is involved. 2) It is claimed in the petition that a representation is made to the State Government, but there is no statement that the representation is received by the State Government and acknowledgment, if any, has also not been produced. In view of this, we are unable to direct the State Government to decide the representation within a stipulated period.

3) If petitioner is entitled to refund of the aforesaid amount, then it is open for him to make

1112wp7440.17 2/2 an appropriate representation to the State Government as per policy dated 12/3/2013, if it continues to exist or any other policy. The State Government shall process the claim of the petitioner and take decision in accordance with law. The petition stands disposed of. All questions are left open.
