DATED : DECEMBER 12, 2019 Mr. Rai, learned counsel for applicant, submits that he wishes to withdraw present application. He further submits that liberty be granted to the applicant to file an application afresh before the Court below since he has not filed the application before Court below after filing of the charge-sheet.

The application is allowed to be withdrawn with liberty to the applicant to file bail application afresh before the Court below, in view of change in the circumstance i.e. filing of the charge-sheet. Learned Judge of the Court below shall decide the application, if filed by the applicant, in accordance with law.

It is made clear that this Court has not heard the application on its own merit.
