DATED : 26/10/2018 This appeal is filed by the accused to challenge the order passed by the Sessions Court dismissing the application filed by him under Section 438 of the Code of Criminal Procedure. The appellant has prayed for grant of pre-arrest bail.
This appeal was called out in the morning session, and it was pointed out to the advocate for the appellant that the appeal is not complying with the requirements of Section 15A (3) of the Scheduled Castes and the Schedules Tribes (Prevention of Atrocities) Act, and the matter was adjourned for afternoon session to enable the advocate for the appellant to take appropriate steps in the matter. The learned APP was also asked to point out to the advocate for the appellant, the defect in the appeal.
When the matter is called out in the afternoon session, the learned advocate for the appellant showed
2 apeal639.18 ignorance in the matter, and no steps are taken in consonance with the requirements of Section 15A (3) of the Act of 1989. Hence, the appeal is not entertained and is dismissed with liberty to the appellant to file fresh appeal, if so advised.
