DATE : November 06, 2017 Considering the fact that challenge is to the order passed by the Family Court directing payment of interim maintenance, the application is taken up for final hearing with the consent of learned Counsel for the parties. By order dated 28-10-2015, the learned Judge of the Family Court directed the applicant herein to pay an amount of Rs.20,000/- per month to the non-applicant by way of interim maintenance. This order is under challenge in the present application. While issuing notice, this Court on 11-22016 by way of interim relief directed the applicant to pay interim maintenance @ Rs.10,000/- per month. It is submitted on behalf of the applicant that this interim order is being duly complied with.

I find that the proceedings before the Family Court are now fixed for recording evidence. Instead adjudicating the rights at this interim stage, the interests of justice could be met by directing said proceedings to be decided on merits expeditiously.

6011BREVN165.15 2/2 Accordingly the following order is passed:

The applicant shall continue to pay interim maintenance @Rs.10,000/- per month to the non-applicant till the proceedings are finally decided by the Family Court. It is clarified that this arrangement is without prejudice to the rights of the parties. The proceedings before the Family Court are expedited and the same shall be decided by the end of April, 2018. The amount of Rs.10,000/- per month shall be deposited with the Family Court after which same can be withdrawn by the non-applicant. The amounts already deposited by the applicant in this Court are permitted to be withdrawn by the non-applicant.

The application is disposed of in aforesaid terms. JUDGE /Muley/
