Heard.

The applicant seeks pre-arrest bail in the crime registered against him for the offences punishable under Sections 65(a), (d), (e), 81, 83 and 108 of the Maharashtra Prohibition Act, 1949.

In the application which was filed by the applicant before the Sessions Court a specific averment was made that he is not involved in any other crime/ offence earlier. It is not the complaint of the non-applicant that after grant of interim order by this Court, the applicant has not cooperated with the investigation. Considering the facts of the case, I am of the view that the interim order granted by this Court on 23rd December, 2016 is required to be confirmed.

Hence, the following order :

2 aba818.16 In the event of arrest in Crime No. 297 of 2016, registered with Police Station, Kelvad, Tahsil : Saoner, District : Nagpur the applicant be released on bail on furnishing P.R. bond for Rs.Twenty Thousand with one solvent surety in the like amount.

The application is allowed accordingly.
