The matter is mentioned by Shri Nandeshwar, learned counsel for the applicant/ petitioner at 3.30 PM. He states that in view of orders passed by this Court on 06.01.2016, he attempted to carry out the amendment and then realized that inadvertently, the orders have been passed in Criminal Application No. 182 of 2015 only and in the absence of orders passed on this application, he is not in a position to carry out the complete amendment. Shri Nandeshwar, learned counsel was in fact seeking circulation of the matter.
However, as Shri J.Y. Ghurde, learned APP for the respondents was available in the Court when the earlier application was allowed, we find no prejudice to the respondents - State, if the error is corrected and present application is also allowed. It is to be noted that the challenge in writ petition pertains to preventive detention. Hence, it is clarified that the order dated 06.01.2016 also grants this Criminal Application and amendment shall be carried out accordingly, in terms thereof.
