Learned counsel for the petitioner expresses an apprehension that if the objection is raised to the tenability of inquiry or the jurisdiction of the officer, in view of the provision of the election petition, the officer may not decide it because of the letters issued by the Hon'ble Minister in this matter.

We find such apprehension unfounded and therefore, we dispose of this petition.

It is expected that the concerned authority shall consider the objection, in accordance with law, if any filed by the petitioner about the tenability of the proceeding.
