The applicant has preferred the present appeal challenging the judgment dated 15th July, 2025, passed by the learned Sessions Judge, Wardha in Special (NDPS) Case No. 2 of 2018, whereby the applicant has been convicted for the offence punishable under Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

The applicant has filed the present application seeking condonation of delay of 25 days in preferring the appeal against the aforesaid judgment of conviction and sentence.

Learned counsel for the applicant submits that due to financial constraints, the applicant was unable to engage legal representation in a timely manner. It is further submitted that the delay is neither deliberate nor intentional, but attributable to circumstances beyond the applicant's control. Accordingly, prayer is made for condonation of the said delay in the interest of justice.

Per contra, the learned Additional Public Prosecutor has opposed the application, submitting that no sufficient cause has been shown for condoning the delay, and hence, the application deserves to be rejected. 5.

Upon hearing the parties and considering the material placed on record, this Court is satisfied that sufficient cause has been made out for the delay. Accordingly, the delay of 25 days in filing the appeal is condoned.

The office is directed to register the appeal. The criminal application stands disposed of.
