Learned APP waives service of notice for nonapplicant No.1./State. CRIMINAL APPLICATION NO. 230/2024 1.

Heard the learned counsel for the applicant/accused and also learned APP on the point of suspension of sentence and release of applicant on bail during pendency of this application. It appears that the learned Trial Court has convicted the applicant/accused for the offence punishable under Sections 354, 354-A of the Indian Penal Code vide Section 248(2) of the Code of

2 15 Revn 186.24 Criminal Procedure. However, the learned Appellate Court i.e. the District Judge-1 and Additional Sessions Judge, Wardha has modified the aforesaid conviction by acquitting the applicant from the offence under Section 354-A of the Indian Penal Code by keeping remaining the order of learned Trial Court as it is.

The record shows that the applicant is on bail during the proceeding before both the Courts below. The applicant has already deposited the fine amount. As such the substantive sentence of imprisonment awarded to the applicant/accused is hereby suspended during the pendency of main revision application.

The applicant be released on PR Bond of Rs. 25,000/- with one solvent surety in the like amount 4.
