The revision application was listed on 18th February, 2016. After hearing Shri A.B. Bambal, advocate for the applicant, it transpired that the delay in filing the revision application may be condoned if the applicant deposits some amount to show bonafides. The learned advocate for the applicant had sought time to take instructions from the applicant.
Today, Shri A.B. Bambal, advocate states that his efforts to contact the applicant on his cellphone have gone in vain as either he is not responding or his cellphone is switched off. The learned advocate for the applicant has placed on record a copy of the notice dated 18th February, 2016 sent by him to the applicant by Speed Post A.D. The learned advocate for the applicant has stated that there is no response from the applicant and he has shown his helplessness in the matter.
The Family Court was constrained to proceed exparte against the applicant as the notice sent through post was not claimed by the applicant.
2 revn187.14 Considering the attitude of the applicant, I am not inclined to show indulgence.
The application for condonation of delay is dismissed with costs quantified at Rs.Ten Thousand to be paid by the applicant to the non-applicant within one month. Consequently the revision application is also dismissed. JUDGE RRaut..
