In the morning session the matter was called twice but none appeared for the applicant. The matter was kept back. In the afternoon session again when the matter is called out there is no appearance on behalf of the applicant.

Heard Shri N.R. Patil, A.P.P. for the respondent / State.

The applicant is arrested on 19th April, 2016 in crime registered against him for the offence punishable under Sections 302, 307 and 449 of the Indian Penal Code. The accusations against the applicant are that he assaulted the mother and father of the complainant Sadhna (aged about 19 years) with whom the applicant / accused had an affair and intended to marry.

The learned A.P.P. has pointed out that the

2 ba1080.16 complainant Sadhna, her father (who is assaulted by the accused) and the matrimonial aunt of the complainant - Sadhna are eye witnesses. The learned A.P.P. has pointed out that the charge-sheet is filed on 14th July, 2016.

Considering the facts of the case, I am not inclined to grant the prayer of the applicant / accused directing the non-applicant to release him on bail. The application is dismissed, however, the Sessions Court is directed to dispose of the trial till 30th November, 2017. If the trial is not concluded till 30th November, 2017, the applicant will be at liberty to reiterate his request. JUDGE Tambaskar.
