This is an application filed by the applicant for relaxation of condition imposed while granting bail that not to enter into Gondia City except on dates of proceeding before court below.

The learned Counsel for the applicant has urged that the applicant was Councilor of Gondia Municipal Council for three times and now he wanted to contest the election of Gondia Municipal Council. Therefore, it is necessary to relax the condition.

The learned A.P.P. opposed the application stating that the applicant is facing a trial for the offence of murder. There is every possibility that he will tamper the evidence. Hence, prayed to reject the application. 4.

Heard both the learned Counsel for the respective parties.

Considering the observations made by this Court while granting bail, the offence which attracts against this applicant is about the conspiracy. The applicant, who was the Councilor for three times and is intending to contest the election, the condition, which was imposed while granting bail, not to enter into Gondia City except on dates of proceeding before court below, is relaxed.
