(Passed on 11.02.2023) The parties have compromised the dispute of the Second Appeal in terms of his compromise pursis. The claimant/appellant is present in person. The Counsel for respondents present.

As per compromise, the compromise has taken place for Rs. 4,55,638/- + 1,25,000/-. Out of it, Rs.4,55,638/- are already deposited in Court and today they are giving cheque of Rs.1,25,000/-.

The respondent No.2 is a formal party.

The cheque of Rs. 1,25,000/- is handed over.

The liberty is given to the respondent No.1 - National Insurance Company to withdraw the deposited amount together with interest by applying due procedure of law.

The Second Appeal is hereby disposed of in terms of this compromise pursis.

Requisite Court free be refunded as per rule. Though the appellant has been identified by Advocate Shri Ajgar Husain as the Counsel for appellant is not present.

The original and necessary documents be returned to the parties as per due procedure of law.
