DATED : 14/12/2018 The grievance of the petitioner is that after dismissal of W.P. No. 1011/2007 on 30/04/2008, the respondents should have implemented the order by which the petitioner was transferred from Thermal Power Station, Khaparkheda to Pune Circle, and as it is not done, it amounts to contempt of Court. To explain the delay and latches, it is submitted that LPA filed against the judgment passed in W.P. No. 1011/2007 is pending.

In the facts of the case, I expressed that I am not inclined to exercise the jurisdiction under Section 12 of the Contempt of Courts Act, 1971. The learned advocate for the petitioner, on instructions, sought permission to withdraw the contempt petition with liberty to agitate his grievance before appropriate forum.

The contempt petition is dismissed accordingly with liberty to the petitioner to take appropriate steps in the matter according to law.
