Heard Mr. Abdul Subhan, learned counsel for applicant and Mr. M.J. Khan, learned Additional Public Prosecutor for non applicant-State.

The applicant is apprehending his arrest in connection with Crime No.130/2017 registered with Police Station, Dhad, District Buldhana for an offence punishable under Sections 465, 468, 471, 406, 420 read with Section 34 of the Indian Penal Code.

In short, the prosecution case is that one Kiran More lodged a report in the year 2017. In the report it is stated that his educational testimonials are fabricated by forging his signature and it is shown that he has taken admission in one Radhey College of Technical Education, Buldhana, when, in fact, he has never taken admission.

According to the prosecution case, the present applicant, who is an employee of Social Welfare Department, has not discharged is duty properly and without ascertaining as to whether the student has appeared in the examination or not, he has endorsed that such a student has appeared in the examination.

This Court has already released the Principal and Junior Clerks of Radhey College of Technical Education, Buldhana. Similarly, other co-accused persons are also released on bail by this Court on different dates (Coram: Manish Pitale, J.) and (Coram: M.G. Giratkar, J.). 7.
The applicant is a Government employee and thus he is available to the course of justice. In the reply filed by the prosecution, it is not the case of the prosecution that applicant has retained any documents causing impediment in the investigation.

In that view of the matter, I pass following order:
ORDER
(i) The application is allowed.
(ii) In the event of arrest in connection with Crime No.130/2017 registered with Police Station, Dhad, District Buldhana for an offence punishable under Sections 465, 468, 471, 406, 420 read with Section 34 of the Indian Penal Code, applicant- Bhimrao Dadaraoji Wankhede be released
on bail on he executing P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.
(iii) The applicant is directed to attend Police Station, Dhad, District Buldhana twice in a week for next two months i.e. on every Saturday and Sunday and shall be with the investigating officer from 11:00 a.m. to 05:00 p.m. The application is disposed of.
