The applicant has apprehension of arrest in Crime No.733/2023 registered with Police Station, Ramnagar, District Wardha for the offences punishable under Section 420 read with Section 34 of the Indian Penal Code.

It is alleged that the complainant along with his friends namely Gopichand Mate in terms of investment has met with Indrajeet Chudiwale and Chandrakant Dhanule, whereby they were informed about the scheme related to Reserve Bank of India. As per said scheme, in 2021 it was informed that both Indrajeet Chudiwale and Chandrakant Dhanule were working for a Company named I-World and they were working in collaboration with Reserve Bank of India for exchange and collection of old currency note. The Company has invited a minimum investment of Rs.25,00,000/- from inverters and in view of their alleged investment, the Company will make profit and will returned of Rs.1,00,000,00/- for an investment of Rs.25,00,00/-. In 2021, the complainant along with Chudiwale and Dhanule went to Bhagalpur, Bihar for looking at the procedure and work undertaken by the

They deposited Rs.5,00,000/- in each into the account of wife of Gopichand Mate and after being convinced with the work undertaken by the alleged Company on 01.07.2021 one Sangita Gopichand Mate has transferred Rs.12,00,000/- and further deposited an amount of Rs.3,00,000/- into the bank account of I-World Company. On the said night, Gopichand Mate called the complainant and informed that Kailash Giri, the present applicant was kidnapped and there was a thread to his life and he has to ran away and the entire money has been duped.

The learned Counsel for the applicant has stated that two co-accused are already protected by this Court by granting anticipatory bail. The role played by this applicant is that he travelled with the co-accused and the statement is made by the co-accused that he was kidnapped and the amount was given for releasing him. This is the only role of this applicant. Hence, prayed to protect the applicant by granting anticipatory bail. 5.

The learned A.P.P. has opposed the application stating that the offence is registered in the year 2023. Since then the applicant is absconding. His custodial interrogation is required to verify whether he was really kidnapped and for that purpose the money which was deposited by the depositors was used. Considering the circumstances, prayed to reject the application. 6.

Heard the learned Counsel for the applicant and the learned A.P.P. for the State.

In same crime, the allegations about depositing and transferring of amount are against Chudiwale and

3 7..aba.786.25 Mohite. They are already protected by this Court in the year 2024. There are no specific allegations about transferring any amount in the account of this applicant. No specific role is allegedly mentioned against this applicant. The co-accused has informed that said person is abducted and the money was used for his release. For verification of said purpose, the custodial interrogation of this applicant is not required. Hence, the application is allowed. Accordingly, I pass following order: i] It is directed that in the event of arrest of the applicant in connection with Crime No.733/2023 registered with Police Station, Ramnagar, District Wardha for the offences punishable under Section 420 read with Section 34 of the Indian Penal Code, he be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand with one solvent surety in the like amount.

ii] The applicant shall not in any way tamper with the prosecution evidence.

iii] The applicant shall not pressurize or threaten the prosecution witnesses.

iv] The applicant shall attend the concerned police station on every Monday between 1:00 p.m. to 2:00 p.m. till filing for the charge-sheet. v] The applicant shall co-operate the Investigating Officer.
