Heard Shri A.M. Kadukar, the learned Advocate for the applicant and Shri A.K. Bangadkar, the learned A.P.P. for the non-applicant.

The applicant is seeking pre-arrest bail apprehending arrest in crime registered against him for the offences punishable under Sections 65(e) and 83 of the Maharashtra Prohibition Act. The allegations are that, substantial quantity of liquor is seized from the vehicle owned by Suman Madpalliwar and that the applicant is working as driver and was driving the vehicle at the relevant time.

It is submitted by the learned A.P.P. that another crime for similar offence was registered against the applicant in 2008. He further submits that Suman Madpalliwar is arrested after the application filed by him seeking pre-arrest bail was rejected.

aba.717.15 2/2 Considering the facts on record, I am of the view that the applicant is entitled for pre-arrest bail. Hence, the following order :

In the event of arrest in Crime No.6215/2015, registered by the non-applicant, the applicant shall be released on bail on furnishing P.R. Bond in the sum of Rs.10,000/- and one solvent surety in the like amount.
