DATE : November 29, 2019 The petitioner in proceedings under Section 14(1)(j-3) of the Maharashtra Village Panchayats Act, 1958 which have been initiated by the respondent Nos.2 and 3 is aggrieved by the orders passed by the Additional Collector refusing to direct fresh spot inspection. Heard Shri C. A. Babrekar, learned counsel for the petitioner and Shri R. S. Kalangiwale, learned counsel for the respondent No.3. It is seen that pursuant to the order dated 27/08/2019 the proceedings were remanded by the Additional Commissioner for fresh adjudication. It is not in dispute that an earlier spot inspection report dated 18/10/2018 is already on record. It is open for the petitioner to object to that report in accordance with law. With liberty to the petitioner to raise a challenge to the order dated 11/11/2019 refusing the prayer to conduct fresh spot inspection in appeal if occasion arises, the writ petition is not entertained. It is accordingly disposed of. The points raised are kept open. No costs. JUDGE Asmita
