CAF No.3195/2018 in F.A. No. 1149 of 2017 Coram : Registrar(Judicial) Dated : 30.10.2018 The Counsel for the applicant has filed application for deleting the name of respondent no.3 from the record. It is stated in the application that the notice issued to the respondent no.3 came to be returned back unserved as the said respondent is reported to be dead. Since all the legal heirs are already on record and are party to the present appeal, no steps are required to be taken against the respondent No.3.

Therefore,the applicant/appellant has prayed for deletion of the name of the respondent no.3 from the array of respondents. The appeal is already abated against the respondent no.3.

Considering that since all the legal heirs of respondent are already on record, the same is allowed and the name of the respondent no.3 is deleted at the risk of the applicant/appellant. Necessary amendment be carried out in the cause title of the Appeal Memo.
