In view of the reasons stated in the application, the application for compounding is allowed.
Ms. T.H. Udeshi, the learned Additional Public Prosecutor is not objecting to the prayer for compounding of the offence, in view of the fact that the incident occurred prior to the amendment by and under which offence punishable under section 324 of the Indian Penal Code is made non-compoundable.
The application is allowed.
The judgment and order dated 02.08.2008 passed by the learned Ad-hoc Additional Sessions Judge, Wardha in Sessions Trial 116/2007 is set aside and the accused are acquitted of the said offence.
The appeal is disposed of, accordingly.
