This is an application for condonation of delay of 458 days caused for filing application for restoration of first appeal which was dismissed for non-removal of office objection i.e. payment of Court fees.

Heard learned advocates for both sides.

Perused the application.

Considering grounds stated in the application and submission of learned advocate for the appellant that, he is ready to pay Court fees within four weeks. Application deserves to be allowed as under:- 5.

The application is allowed. Delay of 458 days is condoned subject to deposit costs of Rs.1,000/- with the Vidarbha Lady Lawyers Association, Nagpur, within four weeks and also subject to deposit Court fees within four weeks.

It is clarified that if the Court fees is not paid and costs of Rs.1,000/- is not paid within four weeks, this application shall be deemed to be rejected without further order.

Application is disposed.

This is an application for restoration of first appeal dismissed for non-removal of office objections. 2.

The learned advocate for the appellant submitted that, he will remove the office objections within four weeks and will deposit the deficit Court fees. 3.

Considering his submission, the application deserves to be allowed. The application is allowed subject to condition, to deposit Court fees within four weeks. 4.

It is clarified that, if the Court fees is not deposited within four weeks, the application shall be deemed to be rejected without further orders. 5.

The application is allowed and disposed.
