IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH, NAGPUR MISC. CIVIL APPLICATION (REVIEW) NO. 643 OF 2022 IN WRIT PETITION NO. 6038 OF 2018 (D) (Shamrao Paiku Nanotkar & Ors. Vs. Project Officer, Soil and Water Management Pilot Project, Nagpur & Anr.) Office Notes, Office Memoranda of Coram, appearances, Court's orders of directions Court's or Judge's order and Registrar's orders.
Shri S.S. Deshpande, Advocate for the applicants/ petitioners. CORAM : A. S. CHANDURKAR , J.
D ATE : OCTOBER 7 , 202 2 .
Heard the learned Counsel for the applicants and perused the grounds raised in support of the review application. The learned Counsel for the applicants sought to rely upon the decisions in i) Allahabad Bank & Ors. Vs. Krishan Pal Singh [AIR 2021 SC 4397]; ii) Ajaib Singh Vs. Sirhind Cooperative Marketing-Cum-Processing Service Society Limited And Another [(1996) 6 SCC 82]; iii) Director, Fisheries Terminal Division Vs. Bhikubhai Meghajibhai Chavda [AIR 2010 SC 1236]; and iv) Ittyavira Mathai Vs. Varkey Varkey and another [AIR 1964 SC 907].
On hearing the learned Counsel for the applicants, it is found that the applicants seek to re-open the proceedings. Under review jurisdiction, it would not be permissible to re-appreciate the material on record and take a different view as sought to be urged by the learned Counsel for the applicants. Such jurisdiction would be available when challenge is raised to the judgment under review.
In the absence of any error apparent on the face of record, I am not inclined to exercise review jurisdiction. The review application is therefore dismissed.
