It appears that in order dated 20.1.2017, inadvertently it is mentioned that leave to amend title of the application was sought by learned Additional Public Prosecutor.
In fact, learned counsel for applicants/original accused has submitted that application for release of Muddemal property on supurdnama was filed which came to be dismissed for default by this Court and, therefore, application for condonation of delay for restoration is moved. Heard learned counsel for the applicants and learned Additional Public Prosecutor for the State. Learned counsel for the applicants has .....2/-
pointed out to order dated 21.8.2014 of this Court by which the appeal was directed to be posted for final hearing on 11.9.2014 with a further direction to consider Criminal Application No.810 of 2013 at the time of final hearing of appeal on merits. It is submitted that the appeal, however, could not be heard while Criminal Application No.810 of 2013, pending appeal came to be dismissed for want of prosecution. The present applications are now filed for condonation of delay and for restoration of Criminal Application No.810 of 2013. Learned counsel for the applicants has submitted that if the appeal is fixed for final hearing, he will not press these applications. Learned Additional Public Prosecution has on objection to fix the appeal for final hearing.
In that view of the matter, Criminal Appeal No.292 of 2010 be shown for final hearing on 16.2.2017.
In view of above, learned counsel for the applicants has not pressed Criminal Application No.1795 of 2016. The said application since not pressed, stands disposed of as dismissed.
