The applicants are seeking bail for offence punishable under section 5(a) of the Maharashtra Preservation of Animal Act read with section 11(C)(5) of Prevention of Cruelty to Animals Act and section 429 of the Indian Penal Code.

The applicants are in custody since 14.6.2019. 3.

Considering the nature of allegations, the gravity of the offence and the period already undergone in custody, I am inclined to grant bail.

It is not even the case of the prosecution that the applicants have adverse antecedents. It appears that the learned Sessions Judge was influenced by the fact that the applicants are residents of Madhya Pradesh, and therefore, it would be difficult to secure their presence. This apprehension can be allayed by directing the applicants to

The applicants are released on bail subject to furnishing P.R. bond of 50,000/- each and a local surety ☜Ҷ for the same amount, to the satisfaction of the trial Court. (Rohit B. Deo, J.) Belkhede RS
