The learned A.P.P. raised objection that the appeal as per proviso below Section 372 of the Code of Criminal Procedure will not be maintainable at the behest of the appellant as he cannot be said to be "victim" under Section 2(wa) of the Code of Criminal Procedure. The learned advocate for the appellant, on instructions, seeks permission to withdraw this appeal to file Criminal Revision Application.
The appeal is disposed as withdrawn with liberty as prayed for.
