This petition takes exception to the order date 07.08.2024 passed by the learned Small Causes Court, Nagpur below Exhibit 28 in RCS No.189/2020.

The respondent herein has filed a suit for eviction and possession against the petitioner. 3.

By order dated 05.12.2023, the learned trial Court directed the present petitioner to pay Rs.2,92,500/- to the respondent towards arrears of rent.

By the order impugned the learned trial court has allowed the application filed by the Prity

2 / 2 17.wp7197.2024 respondent to strike off the defence of the petitioner for non-compliance of the order dated 05.12.2023. 5.

The learned counsel for the petitioner submits that petitioner is not in a position to comply with the order dated 05.12.2023. However, unless the said order is complied with, no indulgence can be shown. The petition is dismissed.
