Heard learned counsel Shri S.Kadam for the applicant and learned Additional Public Prosecutor Shri V.A.Thakare for the State.

The applicant is apprehending his arrest in connection with Crime No.672/2019 registered with Bramhapuri Police Station, District Chandrapur for offences punishable under Sections 65(a), 83, and 82 of the Maharashtra Prohibition Act and under Section 188 of the Indian Penal Code.

On the basis of a secret information received by Police Head Constable, report was lodged on 21.9.2019 that when one Mahindra Scorpio, four wheeler, was intercepted and on its search it was found that it was transporting liquor in Chandrapur district which is prohibited.

The applicant was not travelling in the said .....2/-
vehicle.

According to the prosecution case, the said contraband was being transported by one Pyarasingh @ Pyaru Jagjitsingh Juni and as per the prosecution case it was supplied to the applicant.

From investigation papers, it is clear that there is nothing to show the liquor was to be supplied to the applicant.

The applicant's past record is absolutely clean. 8.
The applicant was protected by this Court on 3.12.2019 with direction that he shall join investigation by attending police station from 6.12.2019 to 13.12.2019. Accordingly, undisputedly, the applicant attended the police station and joined investigation.

In this view of the matter, I pass following order:
ORDER
(1) The criminal application is allowed.
(2) In the event of arrest of applicant-Akshay Bhaurao Navlakhe, in connection with Crime No.672/2019 registered with Bramhapuri Police Station, District Chandrapur for offences punishable under Sections 65(a), 83, and 82 of the Maharashtra Prohibition Act and under Section 188 of the Indian Penal Code, the applicant be released on bail on he executing a P.R.Bond in the sum of Rs.10,000/- with one solvent surety of the like amount.

(3) The applicant is directed to attend the police station as and when he is called by Investigating Officer, however for that Investigating Officer shall give him a 2-day written communication.
With this, the criminal application stands disposed of accordingly.
