"On 3/12/2019 following order was passed :

"Placing reliance on the decision in Sambhaji and ors. vs. Gangabai and ors. 2008(17) SCC 117, it is submitted on behalf of the petitioner that the initial application filed at Exhibit-25 was on completion of ninety days and considering the reasons therein it ought to have been allowed. Issue notice, returnable on 27/01/2020. There shall be ad-interim relief in terms of prayer clause (iii) until further orders."

2.The matter was thereafter not listed nor circulated. None appears for the Petitioner. It appears that after getting order of ad-interim relief, the Petitioner is not prosecuting the Petition diligently. The ad-interim relief granted vide order dated 3/12/2019 stands vacated.

3. Copy of order be served on the trial court, who shall take note of the same in the Roznama and proceed with the suit in accordance with law.
