The applicant has filed this application for temporary bail on the medical ground. The application on merits was rejected.

The learned counsel for the applicant has stated that the applicant is suffering from some problem to his eyes and it requires surgery. He is also suffering from some ENT problems. The medical report is called. It appears that the applicant was regularly taken to the hospital at Bhandara.

3. The learned counsel for the applicant has stated that though he was taken to the hospital, there is no improvement therefore, for good medical treatment, it is Kavita

2 / 2 38-ba 1212-25 necessary to go to the expert and private doctor as eyes are vital part. On perusal of medical report, it appears that, he was not taken to the Medical hospital, Nagpur, where better treatment can be given to him. Instead of releasing him on bail for taking treatment, the direction is given to the jail Authority to refer the applicant to the Government hospital, Nagpur for his medical problems.
