IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH : NAGPUR WRIT PETITION NO. 7517 OF 2018 Pandurang s/o Chinchu Awarkar and another -- Petitioners vs.
Collector (Rehabilitation), Nagpur and another --Respondents Mr. M. V. Mohokar, Advocate for Petitioners.
Mr. A. M. Deshpande, AGP for Respondent No.1 CORAM : NITIN JAMDAR & ANIL S. KILOR, JJ.
DATED : 01 FEBRUARY 2021 P. C. :
This Writ Petition challenges the order passed by the Collector dated 20 June 2017 in respect of a certificate to be issued for employment in the Respondent No.2 Maharashtra State Power Generation Co. Ltd. for its policy of appointment to those persons or their heirs whose lands have been acquired for their Projects. 2.
The impugned order refuses the claim of the Petitioners on the ground that certificate cannot be issued to the Petitioners stating that the heirs and the family members have already taken benefit of such a certificate.

2 / 2 17-WP 7517.2018 3.
The Petitioners have traced their claim to Survey No.332/2. As against this land reference is made to one Jagdish Baliram Awarkar. The Petitioners have filed their say against the impugned order pointing out that the Petitioners have no concern with the person mentioned in the order. There is, however, no specific assertion as regard this Jagdish Baliram Awarkar that Petitioners have nothing to do with him and neither he is a family member. In absence of such assertion we cannot direct the Collector to reconsider his decision. It is open to the Petitioner to approach the Collector with filing an affidavit taking a stand on oath that this person is not a family member of the Petitioners. Thereupon is open to the Collector to look into the grievance made and pass necessary orders.
