IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR WRIT PETITION NO.8389 OF 2019 Gajanan S/o Shankarrao Kshirsagar ... Petitioner

Versus

State of Maharashtra and others ... Respondents Ms. Sunita Kulkarni, Advocate for Petitioner. Mr. Amit Madiwale, AGP for Respondent Nos.1 to 3 and 5. None for Respondent No.4, though served.

CORAM : NITIN JAMDAR & ANIL S. KILOR, JJ DATE : 2 FEBRUARY 2021 P.C. :

The Petitioner is resident of Village Selukate in District Wardha. His grievance is that the Respondent No.4Power Grid Corporation of India Ltd. has erected structures through his agricultural field for the purpose of the Tower of 400101200 KVD (Double Circuit Line Wardha Sancharan Transmission Line), but no compensation is paid to him. The Petitioner also makes a grievance that his representations are not being considered and they are not being placed before the Committee constituted by the Circular dated 25 August 2015. 2.

The notice has been issued. No reply-affidavit is filed.

3.

The Petitioner's grievance that his land is acquired but no compensation is paid, has gone unchallenged. We have perused the Circular dated 25 August 2015, whereby a Four-Member Committee at the District Level is constituted. No other resolution is shown to us, whereby there is a modification in this Committee. The Circular on record also indicates the manner in which the Committee would take the decision.

4.

According to us, it will be appropriate if the case of the Petitioner is forwarded to the Collector, Wardha, who will, in turn, forward the same to the District Level Committee envisaged under the Circular dated 25 August 2015. If the Collector, Wardha has not constituted such Committee for the purpose of deciding the case such as of the Petitioner, the Collector will proceed to establish the same. In case the composition of the Committee is altered or some other Authority is entrusted with the task, the Collector will forward the case of the Petitioner to such Authority. 5.

The Petitioner will furnish the copies of his Petition-Memo to the Collector, Wardha within a period of three weeks from today. Thereafter the Collector, Wardha will proceed to refer the case of the Petitioner to the District Level Committee as above and if the Committee is not already established, will proceed to establish the Committee, which will take necessary decision at the earliest considering the fact that the grievance of the Petitioner is from the year 2011.

6.

With these directions, the Writ Petition is disposed of. (ANIL S. KILOR, J) (NITIN JAMDAR, J) Lanjewar by Prashant Lanjewar Date:
