After having heard this matter for some time and on satisfying that there is no material against the present applicants to constitute the alleged offence, a specific query was put to respondent No. 2, who is an advocate by profession and appeared before this Court through VC, as regards the allegations against the applicants and the material available on record to constitute the offence against the applicants. Thereupon she states that she does not want to proceed against the applicants.

In the circumstances, as there is nothing on record to show that any offence constitute against the present

41.apl.53.2024.odt applicants, as alleged, we are of the opinion that this is a fit case for quashing of the charge-sheet against the applicants. 3.

Accordingly, the criminal application is allowed in terms of prayer clause (i) and (ii).
