15th February, 2017 The claimant seeks permission to withdraw the amount of compensation deposited by the appellant. Perused the judgment of the Reference Court.

In the facts of the case, for the present, the claimant is permitted to withdraw an amount of Rs.50,00,000-00 [rupees fifty lakhs only] on filing an undertaking that in case the appeal is allowed, the said amount shall be repaid with interest at such rate the Court may direct. Further amount of Rs.50,00,000-00 [rupees fifty lakhs only] is permitted to be withdrawn on

furnishing a solvent security.

It is open for the applicant to seek further withdrawal of the amount of compensation. If such request is made, the same shall be considered on its own merits without being influenced by the permission granted on this application.

Civil Application is disposed of.
