Mr. Rajurkar, Advocate submits that the criminal proceeding bearing Summary Criminal Case No.694/2015 pending on the file of Judicial Magistrate First Class, Malegaon is stayed by the Division Bench of this Court. He, therefore, submits that he wishes to withdraw the present application under Section 407 of the Code of Criminal Procedure for transferring the said proceeding to other Court. He submits that liberty be granted to the applicant to file an application of similar nature if occasion arises. 3.

The application is allowed to be withdrawn with liberty as prayed for.

The application is disposed of accordingly.
