The applicant has sought pre-arrest bail apprehending arrest in crime registered against him for the offences punishable under Sections 457, 380 and 411 of the Indian Penal Code. The accusations against the applicant are that during investigation of crime registered on report lodged by Sau. Archana Sunil Gotral, co-accused Santosh @ Balli Durge confessed of committing theft of the golden ornaments from the house of the complainant and stated that he sold the golden ornaments to the present applicant. The Investigating Agency has pointed out that the applicant is involved in other crimes/ offences also and four crimes are registered against him for the offences punishable under Sections 406, 324, 420, 467, 468, 471 and 120 of the Indian Penal Code and 4/25 of the Arms Act.

The applicant suppressed the fact of registration of other crimes/ offences against him. Though the applicant is granted interim protection by the order passed by this

2 aba836.16 Court on 21st December, 2016, considering the facts of the case, in my view, the applicant is not entitled for further protection and the request made on behalf of the Investigating Agency for rejection of his application to enable the Investigating Agency to have custodial interrogation of the applicant is required to be accepted.

Hence, the following order :

The application is dismissed.

The applicant has enjoyed the interim protection granted by this Court by the order passed on 21st December, 2016. The applicant shall surrender within one week. If the applicant fails to surrender within one week his conduct shall be taken note of in all the proceedings pending against him. JUDGE RRaut..
