Marathe, AGP for respondent No.1.
CORAM : NITIN W. SAMBRE & ABHAY J. MANTRI, JJ.
DATED : 07-12-2023 Heard.
2.
The learned Counsel for the petitioner has contended that respondent No.2 has issued a demand notice of property tax to the petitioner. He has also submitted that in a similar type of matter, respondent no.1 has stayed the demand notice. However, they have not considered the said analogy regarding the property tax demand notice issued to the petitioner. He has also invited our attention to Section 169(2)(a) of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (for short "Act"). 3.
Having considered the same, we deem it appropriate to direct the respondent no. 1 to consider this petition as representation and pass the appropriate order thereon as contemplated by the provisions of Section 169(2) a of the Act and communicate the decision thereon to the petitioner within a period of four weeks.
