The learned counsel for appellant has filed pursis stamp no.10716/2018 dated 13.8.2018 praying for withdrawal of instant appeal contending that as per the directions issued by the Central Board of Direct Taxes vide Circular No.3/2018 dated 11.7.2018, no appeal is to be preferred when the subject matter is below Rs.50 Lacs. Subject matter in the appeal is to the extent of Rs.46,13,719/-. In the circumstances, the appeal is allowed to be withdrawn with direction to refund the court fees to the appellant.
