It is stated that by the order dated 6.9.2023 the time of twelve weeks was granted to file the private paper book. However, same was not filed within the prescribed time period and, therefore, the present appeal was dismissed.

This court issued notices to the respondents and Advocate H.N. Verma on last date waives notice on behalf of respondent no.2. 3.

Today the learned counsel for the appellant states that the private paper book is ready and same will be filed within seven working days to the registry of this court. The statement is accepted. 4.

For the reasons stated in the application, the application is allowed. The office is directed to restore First Appeal No.855/2019 and list the matter accordingly as per its turn. 5.

Application stands disposed of.
