IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR WRIT PETITION NO.201/2024 State of Maharashtra and others Vs. Sangita d/o Shankar Bagmare Office Notes, Office Memoranda of Coram, appearances, Court's orders of directions Court's or Judge's order and Registrar's orders.

Ms. D.V.Sapkal, AGP for petitioners.

Ms. Nazia Pathan, Advocate for respondent.

CORAM : NITIN W. SAMBRE & ABHAY J. MANTRI, JJ. DATE : AUGUST 8, 2024.

P.C.

1.

Heard.

2.

The challenge in the petition is to the order dated 8th December, 2021 delivered by the Maharashtra Administrative Tribunal, whereby the petitioners were directed to include the name of the respondent in the waiting list and provide her suitable employment as per her qualification. 3.

The issue is squarely covered by the Full Bench judgment in the matter of Kalpana wd/o Vilas Taram and another Vs. State of Maharashtra and another reported in 2024 (4) Mh.L.J. (F.B.)312.

4. In this background, even if the Assistant Government Pleader is trying to carve out an exception from the aforesaid Full Bench judgment, we hardly see any reason to show any indulgence in our extraordinary jurisdiction.

That being so, we dismiss the petition.

6.

In view of the order of dismissal of the petition thereby including the name of the respondent in the waiting list and providing her suitable employment within a period of eight weeks from today.

7.

By way of last chance, we grant time of eight weeks to the petitioner nos.2, 3, 4 and 5 for reporting compliance of the order of the Tribunal, by way of last chance. (ABHAY J. MANTRI, J.) (NITIN W. SAMBRE, J.) Mukund Ambulkar
