DATED :- FEBRUARY 13, 2024 By preferring this appeal, the appellant has challenged the order passed by the Additional Sessions Judge, Yavatmal in Sessions trial No.70/2023 by which the application of the applicant for bail is rejected. 2.

After hearing the learned Counsel for the applicant to some extent and after going through the investigation papers, it reveals that the victim's case is based on the circumstantial evidence and the incriminating article i.e. weapon is recovered at the instance of the present applicant. The CCTV footage also shows that the applicant is lastly seen with the deceased and the other co-accused.

In view of the same, I have shown my disinclination to grant bail to the present applicant. 4.

Learned Counsel for the applicant seeks permission to withdraw the application.
