07th February, 2017 The petitioner has approached this Court, contending that though on the complaint of the petitioner, the Director General of Police has directed an enquiry to be conducted, no enquiry has been conducted by the subordinate officers.

Learned Addl. Public Prosecutor, Mr. M.K. Pathan, has placed on record a communication dated 6th February, 2017, addressed by the Police Inspector, Anticorruption Bureau, Nagpur, to the Office of Pubic Prosecutor, Ngpur. The same is taken on record and marked 'X' for identification. The perusal of the said communication would reveal that the Investigating Officer has recorded the statement of the present petitioner on 13th April, 2016. The perusal of said

communication would also reveal that after recording the statement of the petitioner, the enquiry was conducted. Not only this, but a discreet enquiry was also made by the Investigating Officer.

After conducting a detailed enquiry, the Investigating Officer has come to the conclusion that the allegations made by the petitioner are without any substance. It has been found that none of the respondents have misused their positions. It has also been found that no loss to the public exchequer is caused by the action or inaction of any of the respondents. The report further states that the Director General has been moved for closing the matter. In that view of the matter, we find that nothing survives in the present petition. Petition is dismissed. Judge Judge.
