This petition takes exception to the order dated 31.08.2024 passed by the District Judge, Nagpur below Exh.5 in R.C.A. No.121/2024.

By the order impugned, the first Appellate Court has stayed the decree of possession passed by the learned trial Court in favour of the present petitioner subject to certain conditions.

I have perused the impugned order. One of the grounds, on which appeal is filed, is in relation to the jurisdiction of the Civil Court to entertain the suit. In that view of the matter, I am not inclined to entertain the present petition against the impugned order. However, considering the facts and circumstances of the case, the learned first Appellate Court shall endeavour to decide the appeal in question within a period of nine months from the date of receipt of the copy of this order.
