The order, of which contempt is pleaded, has been passed by Family Court on 09.10.2023, by which the respondent-husband was directed to take the wife for cohabitation within a period of one month from the date of passing of the order and in the event of failure to do so, the respondent was directed to pay an amount of Rs.30,000/- per month with effect from 10.11.2023. This one month will expire on 10.12.2023. The petition has been filed even prior to completion of one month. Thus, the petitioner has hurriedly approached this Court. At this stage, the counsel for the petitioner seeks time to prepare himself and satisfy the Court that even in such circumstance, a case will be made out as regards the willful disobedience of the order. Time is granted, however, the learned counsel is put on notice that heavy costs will be imposed if it is found that the petitioner has, without justifiable reason, filed the contempt petition.

At this stage, learned counsel for the petitioner seeks permission to withdraw the contempt petition. Permission is granted.

The contempt petition is dismissed as withdrawn.
