This is a joint application by the appellants and the respondent under Order 23 Rule 3 of the Code of Civil Procedure, for passing a compromise decree.

Learned Counsel for the appellants as well as learned Counsel for the respondent submits that the parties have settled the controversy regarding the subject matter of the appeal and accordingly the terms of compromise are stated in the application itself at paragraph no.2(A) to (H). It is submitted that the parties have signed on the joint application and have prayed for passing a compromise decree. It is also stated that all the parties to the appeal are personally present today before the Court to whom the Counsels have identified. Accordingly, application is allowed.

Second Appeal is disposed of in terms of the compromise. 4.

Decree be drawn up accordingly.
