DATED : 17-12-2024 By present application, the applicant - original respondent is seeking permission to withdraw the amount of Rs. 2,88,000/- deposited by the non applicant - original petitioner in compliance to order dated 27-6-2024 passed by this Court in Writ Petition No. 4378/2023. 2.

On 11-12-2024, following order was passed.

"None appears for the non applicant-petitioner, though copy has been served by the applicant's counsel to the counsel appearing for the non applicant.

In order to give one more opportunity, issue notice to the non applicant, returnable on 17.12.2024.

Registry shall also file report as regards the amount deposited by the non applicant."

None appears for the non-applicant even today. Notice issued by the Registry to non-applicant is awaited. 4.

Learned counsel for the applicant submits that the applicant - wife is a poor lady and has a child to be maintained. She is facing difficulty in maintaining herself.

The Registry has also filed report stating therein that an amount of Rs. 2,88,000/- has been deposited by the non-applicant in this Court.

In view of the above and for the reasons stated in the application, the application is allowed as prayed for. The amount be remitted in the account of the applicant - original respondent at the earliest.
