By this application, the appellant has sought leave to file appeal against the order dated 18.9.2018 passed by the Special Judge for 138 N.I. Act, Nagpur in S.C.C. No.17425/2016 whereby the complaint filed under Section 138 of the Negotiable Instrument Act by the complainant was dismissed in default.

Heard the learned advocate for the appellant and the respondents. Perused the application. I have considered the grounds of challenge mentioned in the appeal and I am satisfied that a case is made out for grant of leave. Hence, leave as prayed is granted. Appeal be registered.
