The petitioners had prayed for a declaration that the application moved by them for seeking sanction of the building plan on 16.08.2018 is deemed to have been allowed. The learned counsel for the petitioners on instructions submits that the petitioners are willing to submit a fresh proposal for seeking sanction of the building plan that is stated to be now constructed.

In view of aforesaid, the writ petition is disposed of by passing following order:

(i) The petitioners are at liberty to submit a fresh proposal for seeking sanction of the building plan. If the proposal is accordingly submitted by the petitioners in accordance with the requisite provisions, the Municipal Council shall consider the same in accordance with law.

(ii) The writ petition is disposed of. No costs.
