The subject matter of the present petition is a well. The petitioner has filed the petition stating that the said well is a public Well from which all the villagers are drawing water. It is also stated in the petition that the petitioner was not a party to the proceedings before the authorities below. However, he has filed the petition in order to ventilate the cause of all the villagers. 2.

The petitioner has filed an affidavit dated 13.10.2025 seeking to withdraw the petition. The said affidavit was tendered across the bar during the course of hearing on 13.10.2025. The petitioner was referred to the learned Registrar (Judicial) for verification. The learned Registrar (Judicial) has submitted a report on 13.10.2025 confirming that the petitioner had filed the said affidavit and that he wanted to withdraw the petition. Since the well

45.wp.307.2021.odt in question is stated to be a public well, Civil Application No.2587 of 2025 is allowed, granting permission to the applicants to prosecute the petition as petitioners. All objections pertaining to the locus of the applicants are kept open.
